These Terms of Service ("Terms") explain the rules for using the Ask Health website at ask-health.net and any pages, forms, or content on it (the "Site"). Please read them before you use the Site.

Agreeing to these terms

By visiting the Site, browsing its pages, or submitting the contact form, you agree to these Terms. If you do not agree with them, please do not use the Site.

This agreement is between you (the person using the Site) and Ask Health LLP, the organization that operates and maintains the Site. Throughout these Terms, "we," "us," and "our" refer to Ask Health LLP.

If you are using the Site on behalf of a hospital, post-acute care facility, medical group, or other organization, you confirm that you have the authority to accept these Terms for that organization.

Agreeing to these Terms is not consent to receive text messages. Text message consent is given only through a separate, optional checkbox that is unchecked by default, and it is never bundled with acceptance of these Terms or of our Privacy Policy. What this website is

The Site exists to do two things:

• Share general information about Ask Health, the specialties we support, the facilities and health systems we work with, and how our hybrid model of in-person clinicians and digital monitoring works.
• Give you a way to reach us through the contact form, phone, or email so we can answer questions or start a conversation about working together.

What this website is not

This is the most important section on the page, so we will be direct about it.

• The Site is not medical advice. Everything on it is general information. It is not tailored to any individual, condition, medication, or situation.
• The Site does not diagnose anything. Nothing you read here can tell you what is wrong with you or with someone you care for.
• The Site is not a substitute for professional clinical judgment. Always talk to a qualified physician or clinician about your own health or the health of a person you care for. Never delay seeking care, and never stop or change a treatment, because of something you read on this Site.
• Using the Site does not make you a patient. Browsing these pages, submitting the contact form, emailing us, or texting us does not create a physician-patient relationship, a clinician-patient relationship, or any treatment relationship with Ask Health LLP, Ask Health PA, or any individual clinician. That relationship is established only through a formal intake and evaluation process with a licensed clinician.
• The contact form is not for clinical questions. Please do not use it to describe symptoms, ask what a test result means, request a prescription or refill, or ask for treatment guidance. We cannot answer those questions through a website form, and messages sent through it are not monitored continuously.

If this is an emergency, call 911

Do not use this website, the contact form, email, or text messaging to report a medical emergency. If you or someone you are caring for is experiencing a medical emergency — including symptoms of stroke, chest pain, difficulty breathing, a serious fall or injury, an overdose, or thoughts of harming yourself or someone else — call 911 immediately or go to the nearest emergency department.

You can also reach the 988 Suicide & Crisis Lifeline by calling or texting 988.

Messages sent through this Site, by email, or by text are not monitored continuously and may not be read right away. Waiting for a reply is never an appropriate response to an emergency.

Who provides clinical care

We want this to be unmistakably clear, because the distinction matters:

All clinical services are provided by licensed physicians and clinicians practicing within an independently owned and operated medical practice, "Ask Health PA." "Ask Health LLP" does not provide any medical, nursing, or other healthcare provider services.

Ask Health LLP provides administrative, technology, operational, and support services. It does not practice medicine, does not employ clinicians in the practice of medicine, and does not direct or control the clinical judgment of any physician or clinician. Clinical decisions belong to the licensed clinicians of Ask Health PA and to the patient.

Text messages (SMS) and your mobile information

We never sell or share your mobile information

Mobile phone numbers and text messaging consent collected by Ask Health are never sold, rented, or shared with third parties, affiliates, or lead generators for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties for any purpose other than delivering the messages you asked us to send.

The only parties who ever see your mobile number in connection with our messaging program are the telecommunications and technology vendors that are strictly necessary to send the messages you requested, and those vendors are not permitted to use your number for their own marketing or to resell it. This same commitment appears in our Privacy Policy and in our SMS / Messaging Terms.

How you opt in, and what consent does and does not cover

We send text messages only to people who have separately and affirmatively opted in. Consent is collected through a standalone checkbox that is unchecked by default, sits directly beside the mobile number field, and is never combined with acceptance of these Terms, our Privacy Policy, or any other agreement. Simply entering a phone number on the contact form does not opt you in to text messages.

Consent to receive text messages is not a condition of purchase and is not required to receive care, services, treatment, or a response from us. You can decline texts, or stop them later, and everything else works exactly the same way.

What our messages are and how to stop them

• Who sends them: Ask Health, at the mobile number you provide.
• What they cover: replies to a request you submitted, appointment scheduling, confirmations and reminders, care-coordination logistics, and customer support. Our SMS / Messaging Terms are the authoritative description of the program, and your consent covers only the message categories described there.
• Message frequency varies.
• Message and data rates may apply.
• Reply STOP to cancel at any time. You will receive one confirmation message and then no further texts. Opting out does not affect your care or our willingness to respond to you by phone or email.

Email and text are not secure

Standard email and SMS text messaging are not secure channels. Messages can be delayed, misdirected, or seen by others with access to your device or accounts. Do not send sensitive health details, insurance identifiers, or other confidential information by email, text, or the website contact form. If you need to share clinical information, contact the practice by phone and ask how to provide it through its own intake process. We make no representation here about how any particular message is treated under health privacy laws — treat these channels as open, not confidential.

Using the site responsibly

You may use the Site for lawful purposes — reading about our work, learning about our services, and contacting us. You agree that you will not:

• Submit false, misleading, or impersonated information through any form on the Site.
• Submit another person's health information, personal details, or mobile number without the right to do so.
• Use the Site to send spam, solicitations, malware, or any harmful or automated bulk messages.
• Attempt to gain unauthorized access to the Site, its servers, its data, or any connected system.
• Scrape, harvest, copy, or systematically extract content or contact information from the Site.
• Interfere with, overload, disrupt, or attempt to disable the Site or the network behind it.
• Reverse engineer, probe, or test the security of the Site or any related system.
• Use the Site in any way that violates applicable federal, state, or local law.

We may suspend or block access to the Site by anyone who violates these rules, without notice.

Who owns the content on this site

The content on the Site — including text, page copy, articles, graphics, photographs, illustrations, icons, layout, design, and the Ask Health name and logo — is owned by Ask Health LLP or used with permission, and is protected by copyright, trademark, and other laws.

You may read the Site, print pages for your own reference, and share links to it. You may not copy, republish, sell, license, adapt, or use our content or branding for commercial purposes, or in any way that suggests we endorse you, without our written permission.

Any names, logos, or trademarks belonging to other organizations that appear on the Site remain the property of those organizations.

Links to other websites

The Site may link to websites, tools, or resources operated by other organizations. We include those links because we think they may be useful, not because we control or endorse them.

We do not review, monitor, or take responsibility for the content, accuracy, availability, privacy practices, or security of any third-party site. When you follow a link away from our Site, that other organization's terms and privacy policy apply, not ours. Visiting third-party sites is at your own risk.

Accuracy of information, and no warranty

We work to keep the Site accurate and current, but we cannot promise that it always is. Information about services, specialties, locations, availability, and clinicians can change, and pages may contain errors, omissions, or content that has become out of date.

The Site and everything on it is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Site will always be available, that defects will be corrected, or that the Site or the servers behind it are free of viruses or other harmful components.

Neither we nor the mobile carriers are responsible for delayed or undelivered text messages.

Limits on our liability

In plain terms: use the Site for information and to get in touch with us, but do not rely on it as a source of medical guidance, and understand that there is a limit to what we can be held responsible for.

To the fullest extent permitted by law, Ask Health LLP and its owners, officers, employees, contractors, and vendors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business, arising out of or related to your use of — or inability to use — the Site. This applies regardless of the legal theory behind the claim and even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for all claims relating to the Site is limited to [LIABILITY CAP — amount to be set by counsel].

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Importantly, this section applies to your use of the website. It does not limit, and is not intended to limit, the professional responsibilities that Ask Health PA and its licensed clinicians owe to their own patients under applicable law.

Changes to these terms

We may update these Terms from time to time — for example, when our services change or when the law changes. When we do, we will post the revised version on this page and update the "Last updated" date at the top.

Changes take effect when they are posted. If you continue using the Site after that, you are accepting the updated Terms. Changes to these Terms never expand your text messaging consent: if we want to send you a category of message you did not agree to, we will ask you to opt in again. It is a good idea to check this page occasionally.

Governing law

These Terms are governed by the laws of the State of [STATE — to be set by counsel], without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in [STATE — to be set by counsel], and you and we agree to the jurisdiction of those courts.

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in effect. If we do not enforce a provision right away, that does not mean we have given up the right to enforce it later.
